On September 14, Arizona became the first state to sue the Biden administration over recent rules enforcing private sector and federal employees to receive COVID-19 vaccinations.
According to the complaint filed by the U.S. District Court of Arizona, the state is arguing that the vaccination mandates are unconstitutional since the federal government hasn’t required similar rules for people immigrating across the southern border.
Republican Attorney General Mark Brnovich said the Biden administration’s policies exemplify “unmistakable” favoritism of illegal immigrants over American citizens’ rights.

“The federal government cannot force people to get the COVID-1a9 vaccine. The Biden Administration is once again flouting our laws and precedents to push their radical agenda,” Brnovich said in a statement. “There can be no serious or scientific discussion about containing the spread of COVID-19 that doesn’t begin at our southern border.”
“The same Administration that would not dream of infringing upon the right of unauthorized aliens to choose whether to be vaccinated (or not), has no equivalent regard for the rights of United States citizens.”
“President Biden’s campaign promises of lax immigration enforcement and loose border security, Defendants have created a crisis at the southern border leading to an unprecedented wave of unlawful immigration into the U.S., And even though about one in five aliens arriving in the United States without authorization are infected with COVID-19, Defendants let these aliens refuse vaccination, thus protecting aliens’ freedom and bodily autonomy more than for American citizens,” his complaint read.
On Thursday, the Biden administration introduced a new mandate for the Department of Labor to enforce “all employers with 100 or more employees to ensure their workforce is fully vaccinated or require any workers who remain unvaccinated to produce a negative test result on at least a weekly basis.”
Biden’s order also mandates for millions of federal executive branch employees and contractors to obtain the vaccination.
